1. Overview
The Botx online ordering platform (“Botx”) provides merchants with tools for digital menus, QR ordering,
and online payments. The web address Botxgo.com is simply the hosted URL where merchants' Botx
stores can be accessed. Botx is a technology platform only. It is not a restaurant, delivery company, or
payment processor. All food, products, services, and payments are the responsibility of the Merchant
you place an order with. We strive to make our web content accessible and are working toward WCAG
2.1 AA conformance. If you need assistance or an accommodation, contact the Merchant directly.
2. Orders and Payments
Orders made through Botx are agreements between you and the Merchant only. Payments are
processed by the Merchant’s payment processor, not Botx. Botx uses phone number verification codes
for login and payments (including Apple Pay or other wallets) to reduce fraud. Digital receipts are stored
to provide transaction history. By logging in or using a verification code, you agree to these Terms and
the Privacy Policy.
3. Customer Accounts
Customers may log in with a phone number to view receipts, past orders, or optional features.
Customers may subscribe or unsubscribe from a Merchant’s SMS offers at any time. The My Account
area may expand with new features without prior notice. Continued use constitutes agreement to those
changes. Merchants are responsible for customer data backup and export; Botx does not allow
exporting subscriber data.
4. Prohibited Use
Botx may not be used for: illegal activities of any kind; orders by minors without parent/guardian
supervision (see Section 17); placing false orders, harassment, or misuse of features (e.g., service
bell). Violations may result in account suspension, termination, and possible reporting to authorities.
5. Merchant Responsibility
The Merchant is solely responsible for food/service quality, pricing, preparation, refunds, and delivery.
Botx is not responsible for: cash discount or dual pricing programs; refunds, cancellations, or
chargebacks; customer complaints about food, products, or delivery.
6. Accessibility
Botx integrates third-party accessibility tools (such as UserWay). Botx is not responsible for errors,
outages, or limitations of accessibility tools. Botx is not liable if a user with disabilities cannot use the
system. Merchants are encouraged to ensure accessibility compliance for their own content.
7. SMS Notifications
Customers may receive SMS notifications (e.g., order updates, promotions). Standard carrier charges
may apply. Botx is not responsible for carrier delays or fees. Customers can unsubscribe at any time.
8. Privacy Policy
Botx collects limited personal data (e.g., phone number, orders, receipts). Data is shared only with the
Merchant and necessary third parties (processors, SMS carriers). Botx does not sell or rent personal
data to unrelated third parties. If a Merchant account closes, associated data may be deleted after 30
days. Users located in the European Union are advised that Botx is not subject to GDPR, but we aim to
handle data in accordance with generally accepted privacy standards. For U.S. customers, please refer
to our Privacy Policy.
9. Service & Feature Limitations
Botx does not guarantee uninterrupted service or error-free operation. Features (such as table QR,
service bell, Apple Pay support, receipts, or order history) may be changed, suspended, or removed at
any time. All services are provided “as is.”
10. Customer Security
Customers are responsible for keeping their devices, phone numbers, and login codes secure. Botx is
not liable if others access your account, order history, or SMS messages via your phone or account
11. Data Accuracy & Payment
Order totals, receipts, and reports generated by Botx are for convenience only. Final settlement, timing
of deposits, and amounts are determined by the Merchant’s payment processor, not Botx. Small
differences may occur due to rounding or processor rules.
12. Third-Party Services
Botx integrates with third-party services (e.g., processors, SMS carriers, delivery apps, accessibility
tools). Botx is not responsible for errors, failures, data breaches, or losses caused by third-party
services.
12A. Alcohol & Age-Restricted Products
Merchants are solely responsible for compliance with alcohol, tobacco, or other age-restricted product
sales. Botx does not verify customer ages or IDs. Merchants must check identification and comply with
all applicable laws.
12B. Product Accuracy & Pricing
Merchants are solely responsible for product descriptions, labeling, pricing, taxes, and ingredient
accuracy. Botx is not responsible for mislabeling, incorrect pricing, or errors in merchant menus.
13. Liability
Botx is not responsible for: food, delivery, or refund issues; cash discount or dual pricing compliance;
service downtime or internet outages; bugs, data loss, or accessibility limitations. Liability is capped at
the amount of fees (if any) paid by you to Botx. See Section 18 for indemnification obligations.
14. Dispute Resolution
Disputes about food, pricing, or service must be resolved with the Merchant. Any disputes with Botx will
be resolved through binding arbitration in Los Angeles, California. No class actions or jury trials are
permitted.
15. No Warranties
Botx is provided “as is” and “as available,” with no warranties, express or implied, including
merchantability, fitness for a particular purpose, or uninterrupted availability.
16. Acceptance
By using Botx (including scanning a Botx QR code or visiting a Botxgo.com link), or logging in with a
verification code, you agree to these Terms and this Privacy Policy.
17. Children & Age Restrictions
Botx is not directed to children under the age of 13. Minors under 18 may only use Botx with the
involvement of a parent or legal guardian. Merchants must comply with all applicable laws regarding
sales to minors. Botx does not knowingly collect personal data from children, and reserves the right to
suspend or terminate accounts created in violation of this section.
18. Indemnification
You agree to indemnify, defend, and hold harmless Botx, its affiliates, officers, employees, and partners
from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or
related to: (a) your use of Botx; (b) your violation of these Terms; (c) disputes with a Merchant; or (d)
your violation of applicable laws.
